Terms of Use for DiveLog Pro

These Terms of Use (“Terms”) govern the use of the DiveLog Pro application (“DiveLog Pro”, the “App”).

By downloading, purchasing, accessing or using DiveLog Pro, you agree to these Terms.

1. Purpose of DiveLog Pro

DiveLog Pro is a digital dive-log and dive-information application.

Among other features, the App may allow users to:

  • record and manage scuba dives;
  • record dive sites and coordinates;
  • store depth, duration, temperature and other dive information;
  • record equipment and gas information;
  • record dive buddies and certifications;
  • upload photographs;
  • record marine-life observations;
  • import compatible dive-log files, including Oceanic+ export files;
  • display dive sites using mapping services;
  • use AI to assist with locating dive sites;
  • use AI to assist with marine-life identification; and
  • generate illustrative images of marine life.

2. IMPORTANT DIVING SAFETY NOTICE

The App is not a dive computer, decompression computer, medical device, or substitute for appropriate diving training, certification, planning, equipment, or professional judgment. Information generated by the App, including AI-generated information, must not be relied upon to make safety-critical diving decisions.

DiveLog Pro must not be used as a replacement for a certified and properly functioning dive computer, depth gauge, pressure gauge, compass, decompression system or other required diving equipment.

Do not use DiveLog Pro to determine:

  • whether it is safe to dive;
  • maximum safe depth;
  • no-decompression limits;
  • decompression obligations;
  • ascent rates;
  • required safety or decompression stops;
  • breathing-gas requirements;
  • gas reserves;
  • oxygen exposure;
  • fitness to dive;
  • emergency procedures; or
  • whether environmental conditions are safe.

Always follow your training, certification limits, dive plan, applicable regulations, established diving practices and the instructions of qualified diving professionals.

3. Diving Involves Risk

Scuba diving is an activity involving inherent risks, potentially including serious injury, decompression illness, barotrauma, drowning and death.

DiveLog Pro does not evaluate whether a user is qualified, medically fit, sufficiently experienced or appropriately equipped to conduct a particular dive.

The user remains solely responsible for decisions concerning whether, when, where and how to dive.

4. No Medical Advice

DiveLog Pro does not provide medical advice.

Information displayed or generated through the App must not be interpreted as diagnosis, treatment, medical clearance or an assessment of fitness to dive.

Questions regarding medical fitness for diving should be addressed to an appropriately qualified medical professional.

In an emergency, users should contact the appropriate emergency or diving emergency services rather than relying on DiveLog Pro.

5. AI-Generated Information

DiveLog Pro uses artificial intelligence for certain features, including assisting users in locating dive sites, identifying marine life and generating illustrative images.

Artificial intelligence can make mistakes.

AI-generated information may be:

  • inaccurate;
  • incomplete;
  • outdated;
  • misleading; or
  • entirely incorrect.

Marine-life identification generated by AI should be treated as a suggestion rather than a definitive scientific identification.

AI-generated images are illustrative and do not necessarily represent the actual animal, species, dive site or observation.

AI-generated location information may also be inaccurate. Users must independently verify coordinates and locations before relying upon them.

AI-generated information must never be used as the sole basis for a safety-critical diving decision.

6. Maps and Dive-Site Locations

Map positions, coordinates, dive-site names and AI-generated dive-site suggestions may contain errors.

A displayed location does not mean that:

  • diving is permitted at that location;
  • access to the location is legal;
  • conditions are safe;
  • the location is suitable for the user;
  • a dive operator is available;
  • currents, tides or weather conditions are suitable; or
  • the coordinates represent an appropriate entry or exit point.

Users are responsible for independently confirming dive-site locations, access restrictions, local regulations and environmental conditions.

7. Accounts

Some or all functionality of DiveLog Pro requires a user account.

Users are responsible for:

  • providing accurate account information;
  • maintaining the confidentiality of their credentials;
  • protecting access to their devices and accounts; and
  • notifying us of suspected unauthorised account access.

Authentication may be available through email/password and supported third-party authentication providers such as Sign in with Apple or Google Sign-In.

8. Dive-Log Accuracy

DiveLog Pro allows information to be manually entered and imported from external sources.

We cannot guarantee that imported, entered, calculated, interpreted or displayed information is accurate.

Users should verify important dive-log information against the original source, particularly where a record is being used as evidence of diving experience, training or certification requirements.

DiveLog Pro does not certify or independently verify that a recorded dive occurred.

9. Oceanic+ Imports

DiveLog Pro may support the import of compatible files exported from Oceanic+.

Compatibility may change if third-party export formats are modified.

We do not guarantee continued compatibility with any third-party file format or service.

Oceanic+ and its associated trademarks belong to their respective owners. Unless expressly stated otherwise, DiveLog Pro and ILS International Language Services Sprachdienst GmbH are not affiliated with, sponsored by or endorsed by the provider of Oceanic+.

10. User Content

Users may store or upload content including dive logs, notes, photographs, files and marine-life observations.

You retain ownership of your content.

You grant us and our service providers the limited rights necessary to host, process, transmit, display, back up and otherwise process your content solely as necessary to operate and provide DiveLog Pro and its requested features.

You are responsible for ensuring that you have the right to upload and process any content you submit.

You must not upload content that is unlawful, infringes third-party rights or contains malicious software.

11. Information About Other People

If you record the name or other information of a dive buddy or another person, you are responsible for ensuring that you are entitled to record and process that information.

Avoid storing unnecessary sensitive personal information about other people.

12. Intellectual Property

DiveLog Pro, including its software, design, branding, graphics and original content, is protected by applicable intellectual-property laws.

Except for rights expressly granted under these Terms, all rights remain with ILS International Language Services Sprachdienst GmbH or the respective rights holders.

These Terms do not transfer ownership of the App or its intellectual property to users.

13. Permitted Use

DiveLog Pro is licensed for personal, lawful use in accordance with these Terms and the applicable App Store rules.

You must not:

  • attempt to interfere with the operation or security of the App;
  • access accounts or information belonging to another user without authorisation;
  • use automated methods to abuse the service;
  • attempt to circumvent security or access restrictions;
  • introduce malware or malicious content;
  • use the App for unlawful purposes; or
  • misuse AI functionality or other services in a manner that causes harm or violates applicable law.

14. Purchase and App Store

DiveLog Pro is currently offered as a one-time purchase rather than an automatically renewing subscription.

Purchases made through Apple’s App Store are also subject to the applicable terms and conditions of the App Store.

Pricing and the commercial model of DiveLog Pro may change for future purchases or future functionality.

Any future paid features, subscriptions or in-app purchases will be presented to users before purchase and will be subject to applicable platform and legal requirements.

15. Availability and Changes

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Features may temporarily be unavailable due to maintenance, internet connectivity, third-party service availability, technical problems or circumstances outside our control.

We may modify, improve, replace or discontinue features where reasonably necessary, subject to applicable consumer law.

Third-party integrations may stop working if a third party changes or discontinues its service, API or file format.

16. Backups and Important Records

Although DiveLog Pro may store dive records, users should maintain appropriate independent copies of important records.

DiveLog Pro should not be treated as the sole permanent repository for records that are legally, professionally or personally important.

17. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer-protection law.

Subject to those mandatory rights, we are not responsible for losses resulting from reliance on inaccurate user-entered, imported, mapped, third-party or AI-generated information where the App was not intended to be relied upon for the relevant safety-critical purpose.

In particular, DiveLog Pro is not responsible for diving decisions made contrary to the safety warnings contained in these Terms.

18. Account Termination and Deletion

Users may stop using DiveLog Pro at any time.

Users may initiate deletion of their account through the account deletion functionality provided within the App.

Account deletion may permanently remove stored dive logs, photographs and other information associated with the account.

Users should export or otherwise retain any information they wish to keep before deleting their account.

We may restrict or terminate access where reasonably necessary because of serious misuse, security threats, unlawful activity or material violation of these Terms, subject to applicable law.

19. Privacy

Use of DiveLog Pro involves processing personal information.

Please review the DiveLog Pro Privacy Policy for information about how personal data is collected, processed, stored and protected.

20. Changes to These Terms

We may update these Terms to reflect changes to DiveLog Pro, applicable law, security requirements or our services.

Material changes will be communicated where required by applicable law.

Continued use following a change is subject to applicable consumer and contract law.

21. Governing Law

These Terms are governed by Austrian law, without prejudice to mandatory consumer-protection rights that may apply to users in their country of residence.

For consumers within the European Union, mandatory jurisdiction and consumer-protection provisions remain unaffected.
